(ANSA) - Strasbourg, January 7 - The European Court of Human
Rights ruled Tuesday that two Italian parents should be allowed
to give their daughter her mother's surname.
Alessandra Cusan and Luigi Fazzo, from Milan, took their
case to the court in Strasbourg after being barred from giving
their daughter the surname Cusan under Italian law.
In Italy children born of Italian parents within wedlock
must legally take their father's surname.
The couple claimed the law was in violation of their right
to respect for private and family life, prohibition of
discrimination and equality between spouses.
The judges ruled that Italy needs to make legislative or
other changes to remedy the situation.
The sentence becomes definitive in three months.
